Hon. Colonial Secretary,

1. I think that paragraph 38 of King's Regulations deals with the regular forces and does not apply to the Hongkong

Volunteers.

2. It is true that section 178 of the Army Act pro- -vides that when auxiliary forces are subject to military law in pursuance of the Act they are subject to the Act as if they were part of the regular forces, and it is also true that section 190 but (12) defines auxiliary forces as including "the volunteers", it seems quite clear that the latter definition does not include any force of volunteers raised in the Colony. Colonial forces are dealt with in section 177, which clearly provides that the Army Act applies to them only subject to the law of the Colony. Sections 175(12) and 176(11) are equally clear.

3. I think that my minute of 3rd. March, 1915, shewa that the Hongkong Volunteer Corps is subject to the regulations of the Governor-in-Council and is under the general control of the

Governor.
